The terms for using Attesta.

Plain-language terms for the Attesta service by Maximinds Ltd. Effective 9 September 2026.

1. About these terms

These terms are an agreement between you and Maximinds Ltd, a company incorporated in Jamaica ("Maximinds", "Attesta", "we", "us"), for your use of the Attesta website, apps and services (the "Service"). By creating an account or using the Service you agree to these terms and to our Privacy Notice. If you don't agree, please don't use the Service.

2. What Attesta does

Attesta verifies the parties to a residential tenancy and shares only verified outcomes — never the underlying documents. Renters build a reusable Rental Passport; landlords, realtors and property managers ("listers") verify their standing and list properties. The Service is a tool to help people transact with more trust. It is not a party to any tenancy, lease, or payment between users, is not a real-estate agent, landlord or lender, and does not provide legal, financial or credit advice.

3. Your account

You must be at least 18 and able to form a binding contract. Give accurate information and keep it up to date, keep your sign-in secure, and don't share your account. You're responsible for activity under your account. We may refuse, suspend or close accounts to protect users or comply with the law.

4. Verification, and what it does and doesn't mean

Verification is carried out by trained human reviewers. A verified outcome means we checked the evidence available to us at that time — it is not a guarantee of a person's conduct, finances, honesty, or the outcome of any tenancy, and it doesn't replace your own judgement or checks. You remain responsible for your decisions. We never pay or receive money for a tenancy between users, and we'll always tell renters not to pay a lister before viewing a property.

5. Listers' responsibilities

If you list a property you must have the right to do so and give accurate details. Realtors must hold a valid licence and be registered with the Real Estate Board of Jamaica; property managers must be registered with the Board; landlords must be able to prove ownership of the specific property. Listings are reviewed before they go public and may be declined or removed. You are solely responsible for your listings, your dealings with renters, and complying with the law that applies to you.

6. Fees, payments and subscriptions

Renters use Attesta free. Listers pay for deep verifications: one-time packs (which don't expire) or a monthly plan. Prices are shown in Jamaican dollars and may include taxes where applicable. Card payments are processed by Ezee Payments on their secure page; Attesta never sees or stores your card number.

A monthly plan renews automatically and is billed to your card each month until you cancel. You can cancel anytime from Settings → Billing; cancellation stops future charges and you keep access until the end of the period you've already paid for. Verifications already performed, and one-time packs, are non-refundable except where the law requires. If a payment fails we may pause paid features until it's resolved. Nothing in these terms removes rights you have under the Consumer Protection Act or other Jamaican law.

7. Acceptable use

Don't use Attesta to break the law, to defraud or impersonate anyone, to post false or misleading listings or documents, to harass other users, or to scrape, disrupt or misuse the Service or its security. We may remove content and suspend or close accounts that do. Suspected fraud may be reported to the relevant authorities.

8. Your data and privacy

How we handle personal data is set out in our Privacy Notice and sub-processor list. Maximinds Ltd is the data controller. By using the Service you consent to the processing described there, which you can withdraw as explained in Your data & rights.

9. Intellectual property

Attesta, its software, brand and content belong to Maximinds Ltd. You keep ownership of what you submit and grant us the limited licence we need to operate the Service and provide verification. You may not copy, resell or reverse-engineer the Service.

10. Availability, disclaimers and liability

We work hard to keep Attesta available and accurate, but the Service is provided "as is" and we don't warrant it will be uninterrupted or error-free. To the fullest extent permitted by law, Maximinds Ltd is not liable for indirect or consequential loss, or for the acts of other users. Nothing in these terms limits any liability that cannot be limited under Jamaican law, including under the Consumer Protection Act.

11. Suspension and termination

You can stop using Attesta and close your account at any time. We may suspend or end your access if you breach these terms, to protect users, or to comply with the law. Some obligations (such as fees already due and the sections on data, liability and governing law) survive termination.

12. Changes to these terms

We may update these terms as the Service evolves or the law changes. We'll post the updated terms here with a new effective date and, for material changes, give reasonable notice. Continuing to use Attesta after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of Jamaica, and the courts of Jamaica have jurisdiction over any dispute, without affecting any mandatory consumer rights you have where you live.
